On 21 December 2011, the Court of Justice of the European Union confirmed the validity of the Directive which includes aviation under the EU’s Emission Trading Scheme (ETSi). In addition, the Court confirmed that the Directive is consistent with the provisions of the Open Skies Agreement designed to prohibit discriminatory treatment between American and European operators. The inclusion of aviation within the EU ETS was contested by US and Canadian airlines and relevant associations in the UK. As a result, the UK raised the issue with the Court of Justice.
